
Texas Music Festivals Enterprise, Inc. (TMF) Terms of Service
Effective Date: March 1, 2026
These Terms of Service (“Terms”) govern your access to and use of services, communications, and platforms operated by Texas Music Festivals Enterprise, Inc., dba “Travel, Merchandise, Festivals” (“TMF,” “we,” “our,” or “us”). By accessing, engaging with, or using TMF services, including receiving communications, attending events, or submitting information, you agree to be bound by these Terms.
1. Use of Services
TMF provides educational programming, events, communications, and related services for music educators, students, and partners.
You agree to use TMF services only for lawful purposes and in compliance with these Terms.
You may not:
• Use TMF services or data for unauthorized commercial purposes
• Copy, distribute, or exploit TMF data, communications, or materials without permission
• Attempt to gain unauthorized access to systems, data, or accounts
• Interfere with or disrupt TMF systems, networks, or operations
• Use TMF services in any manner that could harm TMF, its users, or partners
TMF reserves the right to suspend or terminate access to its services at its sole discretion for violations of these Terms.
2. Communications and Consent
By providing your contact information to TMF, you expressly consent to receive communications including:
• Program updates
• Event invitations
• Educational opportunities
• Marketing and promotional messages
You may opt out of marketing communications at any time using the unsubscribe link included in emails.
You acknowledge that transactional or operational communications may still be sent as necessary.
TMF complies with applicable communication laws, including the CAN-SPAM Act.
3. Data Usage
Your information is handled in accordance with our Privacy Policy.
TMF uses data to:
• Communicate relevant opportunities and updates
• Manage programs and events
• Improve outreach, services, and engagement
TMF does not sell personal data.
4. Third-Party Services
TMF utilizes third-party platforms and vendors (including CRM systems, email service providers, and analytics tools) to operate its services.
By engaging with TMF, you acknowledge and agree that your information may be processed and stored by these third-party providers solely for operational purposes.
TMF is not responsible for the independent practices or policies of third-party providers.
5. Intellectual Property
All TMF content, including but not limited to text, graphics, logos, branding, program materials, and communications, is the property of TMF or its licensors and is protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use TMF content for personal or educational purposes only.
Any unauthorized use, reproduction, distribution, or modification is strictly prohibited without prior written consent.
6. User Conduct and Submissions
If you submit content, information, or materials to TMF (including forms, event participation, or communications), you:
Represent that you have the right to provide such content
Grant TMF a non-exclusive, royalty-free, worldwide license to use, reproduce, and distribute such content for operational and promotional purposes
You agree not to submit content that is unlawful, defamatory, or infringes on the rights of others.
7. Event Participation and Media Release
Participation in TMF events (virtual or in-person) is subject to compliance with all event guidelines and codes of conduct.
By attending TMF events, you acknowledge and agree that TMF may capture and use photographs, video, and audio recordings for promotional, educational, and marketing purposes without compensation.
If you do not wish to be recorded, you must notify TMF in writing prior to the event.
TMF reserves the right to remove any participant for conduct deemed inappropriate, unsafe, or disruptive.
8. Disclaimers
TMF services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.
To the fullest extent permitted by law, TMF disclaims all warranties, including but not limited to:
• Merchantability
• Fitness for a particular purpose
• Non-infringement
TMF does not guarantee that services will be uninterrupted, secure, or error-free.
9. Limitation of Liability
To the fullest extent permitted by law, TMF and its officers, directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to:
• Loss of data
• Loss of revenue or profits
• Business interruption
arising out of or related to your use of TMF services, even if TMF has been advised of the possibility of such damages.
In no event shall TMF’s total liability exceed the amount paid by you (if any) for participation in TMF services within the twelve (12) months preceding the claim.
10. Indemnification
You agree to defend, indemnify, and hold harmless TMF and its officers, directors, employees, affiliates, and partners from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
• Your use of TMF services
• Your violation of these Terms
• Your violation of any rights of another party
11. Termination
TMF reserves the right to suspend or terminate your access to services at any time, with or without notice, for any reason, including violation of these Terms.
Provisions of these Terms that by their nature should survive termination shall remain in effect.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
Any disputes arising out of or relating to these Terms shall be resolved through binding arbitration in the State of Texas, in accordance with the rules of the American Arbitration Association.
You agree to waive any right to participate in class actions or class-wide arbitration.
13. Modifications to Terms
TMF may update or modify these Terms at any time. Continued use of TMF services after such changes constitutes acceptance of the revised Terms.
14. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and TMF regarding the use of services and supersede any prior agreements or understandings.
